License Agreement Provisions to Support Sustainable Access
Agreement provisions that can facilitate sustainable access to a licensed product include:
Is the goal of achieving sustainable access acknowledged as part of the overall access objectives for the agreement?
What type of commitments should the licensee partner make in respect of timely and continuous supply of the licensed product?
Do the affordable pricing commitments under the agreement allow a reasonable margin to support sustainable manufacturing and supply of the licensed product?
Will the licensee be required to enter into sublicense and technology transfer arrangements to support sustainable and affordable supply of the product?
Will the scope of the agreement include activities to support demand generation and sustained use of the licensed product once it is approved for use?
Will factors impacting sustainable supply be addressed as part of an evolving access plan for the product?
This toolkit has been built based on the data in the MAPGuide and the GHIAA team’s experience of negotiating and implementing agreements.
