License Agreement Provisions to Support Product Affordability
Agreement provisions that can have an impact on the affordability of a licensed product include:
Is the goal of making the licensed product available at an affordable price acknowledged as part of the overall access objectives for the agreement?
Will price competition be enabled through non-exclusive licensing?
What type of affordable pricing commitments are appropriate for the context of the agreement?
Will the licensee be required to enter into sublicense and technology transfer arrangements to support a reduced cost of goods and facilitate affordable pricing for the product?
Will pricing strategy and cost of goods considerations be addressed as part of an evolving access plan for the product?
This toolkit has been built based on the data in the MAPGuide and the GHIAA team’s experience of negotiating and implementing agreements.
