Funding Agreement Provisions to Support Sustainable Access

Agreement provisions that can facilitate sustainable access to a funded product include:

 Is the goal of achieving sustainable access acknowledged as part of the overall access objectives for the agreement?

What is the duration of the access commitments under the agreement?

What type of commitments should the funded partner make in respect of timely and continuous supply of the funded product for the access territory?

Do the affordable pricing commitments under the agreement allow a reasonable margin to support sustainable manufacturing and supply of the funded product?

Will the funded partner be required to enter into license and technology transfer arrangements to support sustainable and affordable supply of the funded product?

Will the scope of the funding agreement include activities to support demand generation and sustained use of the funded product once it is approved for use?

Will pricing strategy and cost of goods considerations be addressed as part of an evolving access plan for the funded product?

This toolkit has been built based on the data in the MAPGuide and the GHIAA team’s experience of negotiating and implementing agreements. We intend that the toolkit will evolve and expand over time based on input from MAPGuide users and availability of new agreements showing examples of alternative approaches.
